PERSONAL
Most of the information you need regarding real estate will be obtained from these records including TYPE of real estate owned, LOCATION, DEBT associated with this real estate, any CO-OWNERS and taxes outstanding.1.DEEDS to all real estate in your name, your husband's name or joint names.
BUSINESS - CORPORATE, PARTNERSHIP OR SOLE PROPRIETORSHIP
2.MORTGAGES and mortgage notes for all real estate in your name, your husband's name or joint names.
3.Real Estate CLOSING STATEMENTS and contracts.
4.Real Estate TAX records.
5.APPRAISALS and market analysis of real estate.
With respect to items 6 through 15, the TAX RETURNS and PAY STUBS will be used to determine actual income. The balance of the documents will show how the family income is expended.
6.TAX RETURNS (last five years).
7.Your PAYCHECK STUBS - your last eight stubs.
8.Your HUSBAND'S PAYCHECK STUBS - last eight pay stubs.
9.Monthly BANK STATEMENTS and CANCELED CHECKS with DEPOSIT SLIPS, preferably for the last ten years but five years may be sufficient.
10.Bills for living expenses - records for MONTHLY EXPENSES such as utilities, water, sewers, cable TV, child care, automobile loan payments.
11.Bills for HOME IMPROVEMENTS.
12.OTHER SOURCES OF INCOME - All check stubs for social security benefits, unemployment benefits, disability income.
The items below will alert your attorney to liabilities and debts which must be satisfied.
13.JUDGMENTS AGAINST you or your husband.
14.JUDGMENTS HELD by you or your husband.
15.Copies of all documents showing DEBT.a.CHARGE CARD STATEMENTS and copies for the last three years.
Document numbers 16 through 20 will be used to determine value of assets and used to trace assets which may be hidden.
b.All PROMISSORY NOTES.
c.CAR LOAN documents including present amount due.
16.DIVIDEND and INTEREST statements.
17.SAFE DEPOSIT BOX - list of contents. If documents, copies of contents.
18.INHERITANCE - any documents regarding inheritances received by you or your husband. Preferably copy of will and documents showing amounts of inheritance received.
19.LOAN APPLICATION - car loan, personal loan, mortgage loan or any other secured or unsecured loan.
20.Savings accounts, certificates of deposit, IRA's and any other documents showing SAVINGS. Include savings accounts or certificates closed or withdrawn over last two years.
The following documents relate to insurance. They will assist in determining value of assets and protection provided in the event of death of a wage earner.
21.All LIFE INSURANCE policies.
22.All PROPERTY and LIABILITY insurance policies.
23.Family HOSPITALIZATION plan.
The miscellaneous documents, 24 through 28, will provide actual earning capability, other possible sources of income and additional information you may need.
24.Appointment DIARIES.
25.U.S. PASSPORT.
26. Power of Attorney.
27.CLAIMS made:
a.Automobile accidents.
b.Accidents at work.
c.Claims against others for damage.
28.RESUME of husband.The following documents will supply retirement assets and anticipated retirement income.
29.KEOGH plan documents.
30.401K documents.
31.PENSION plan records.
Items 32 through 42 will help your attorney determine the value of the business, number of owners, earning record, and nature of business.
32.TAX RETURNS for business owned wholly or partially by you or your husband.
33.MONTHLY BANK STATEMENT, canceled checks and deposit slips.
34.BALANCE sheets, profit and loss statements, income statement, operational statement for last five years including year end and preferably interim.
35.LOAN applications.
36.APPOINTMENT diaries.
37.ADVERTISING brochures and material given to prospective customers.
38.PARTNERSHIP agreements and other business agreements.
39.BUY/SELL agreements.
40.Business CREDIT CARD records.
41.Corporate documents including BY-LAWS and ARTICLES OF INCORPORATION.
42.Husband's BUSINESS CARDS.
These will assist in ascertaining REAL ESTATE owned by the business.
43.APPRAISAL of business owned real estate.
44.DEEDS, mortgages and mortgage notes of real estate.
45.PROFIT SHARING through employment documents.
46.Office LEASE.
47.Records showing ACCOUNTS receivable and accounts payable.
