She is a member of the New York State Bar Association, the Women's Bar Association, and the Suffolk County Bar Association. She was also a member of the American Bar Association. She was formerly a volunteer as a Court Appointed Special Advocate for foster care children reporting to the Court about the conditions of children living in foster care. She is active in her community, her children's school, and in her religious community. She is also admitted to practice law in Federal Court in the Eastern and Southern Districts of New York.
Ms. Michalczyk has been in business since 1984, serving a wide variety of clients. She practices in the areas of Immigration, Family Law, Divorce Law, Matrimonial Law, Trusts and Estates, Personal Injury and General Practice. She practices in the Counties of Nassau, Suffolk, Queens, New York, Kings and Westchester. She also handles all phases of Appellate work. She handles novel and difficult areas of practice with multiple approaches to litigation or to a business or legal problem.
Most people come to lawyers because they have a problem that they want to solve or to prevent a problem before it happens. Ms. Michalczyk helps find solutions to problems, and renders advice to prevent costly mistakes in litigation before it starts. Her diverse talent and training gives her the ability to handle novel and interesting areas of law. For example, if you are divorced, sharing a parenting arrangement, consult an attorney before moving out of the geographical area that you presently reside in. It can save you thousands in litigation costs. Should you appeal, an Order of the Court, and how do you appeal and what are the costs involved? Consult Ms. Michalczyk about what you need to know before you start a divorce action. Does equitable distribution mean equal distribution?
If you want a lawyer who is willing to fight your cause and is willing to listen to you, you have found her. She makes every attempt to settle your case amicably, quickly and cost effectively, but if you cannot settle this attorney will fight your battles for you in a just, dignified, efficient, and ethical manner. Highly experienced in estate and matrimonial matters involving valuation of businesses and taxation. Highly experienced in Appellate work.
Many cases in Ms. Michalczyk's office are settled prior to any Court intervention because there are no winners in matrimonial or other litigation. This attorney tries to achieve a just resolution for her clients, understanding that there are certain injustices inherent in any large system. This attorney is highly equipped to litigate to achieve bargaining power for you so that you do not have to go to trial, but if you do have to go to trial, she is prepared. Her motto is: "Prepare your case as if you are trying it, and hopefully you will not have to". She has been featured on Television and in the newspapers, involving a multitude of issues, including domestic violence and custody disputes. Her book on the treatment of children in the Court System and those designed to protect the children in the Courts is to be published shortly.
Please feel free to give Mildred J. Michalczyk, Esq. a call for information on her newly forming support group which will be free, and will discuss what really goes on in the Courthouses as well as the role of the family in the Court. Meeting times and locations will depend upon interest in the group.
The first topic she will address will be, does there need to be a change in the ethical rules relative to divorce and family law proceedings? Has your adversary failed to disclose? What if your client fails to disclose an asset in litigation? How does a bankruptcy affect a divorce proceeding? Has your adversary or your own client been less than honest about certain matters involving income and children? What to do if your adversary violates an Order? Should letter motions be permitted in the New York State Court to save the cost of an application?
Remember, you should consult with an attorney far in advance of any litigation to find out how the Court system really works. You should consult with groups that educate rather than teach you the "tricks"; most Judges and lawyers have been around a long time and know the tricks.
Courts and litigation involve adversary proceedings. All attorneys should try within reason to settle your claim. However, if you cannot settle, and your adversary is not reasonable, the forum that is utilized to resolve your dispute is the Courts. There is a Plaintiff and a Defendant; there are lawyers on each side to advocate the respective positions of their respective clients and there is one (1) winner.
Take advantage of the newly forming support group to learn how to use the law to your advantage in an ethical, just, dignified, efficient, and cost effective maimer so that you can keep legal costs to a minimum and find a solution to your problem.
