The wife appealed from the denial of her motion to obtain a share of the pension benefits available to the husband and from the denial of an entry of a QDRO. The appellate court held that it was inequitable for the trial justice to allow the husband to unilaterally deprive the wife of her share of the pension by delaying retirement. The refusal to grant pension benefits was contrary to both statutory and case law. Janson v. Janson, No. 99-490 (R.I. June 25, 2001).
