NEW YORK: Allwell v. Allwell, ___ A.D.2d ___, 716 N.Y.S.2d 741 (2000). The husband claimed that part of his pension represented compensation for personal injuries and thus was not subject to equitable distribution in its entirety. Here, the couple was divorced in July 1999 following a trial. The judgment of divorce provided, among other things, that the entirety of the husbands pension plan acquired during the marriage was marital property subject to equitable distribution. The husband appealed this decision.
