Document summary:
At the time of the divorce, both the husband and the wife had or were eligible for military retirement. Both the husband and the wife were approximately forty-eight years old at that time. The husband was retired from active duty and received both military retirement and a disability benefit; the disability benefit was not in issue in this case. The wife served eleven years on active duty, and the last thirteen years on active reserve, and therefore had performed more than twenty years of service. However, because she performed part of the necessary creditable years in the reserves, the wife would not receive retirement benefits until the age of sixty.
