The doctrine of res judicata does not require an individual to litigate a tort claim against a spouse in the parties dissolution proceeding, the Connecticut Supreme Court decided. The court concluded that the policy considerations commonly advanced to justify the doctrine of res judicata are not compelling in this context and that application of that doctrine to bar a later interspousal tort action would fail to achieve the doctrines objectives.
