When the Court Chooses an Evaluator
Sometimes the judge selects the custody evaluator. This happens when the parents are unable to agree on a custody evaluator (or the judge operates this way). When this happens, the parents are somewhat limited for obvious reasons. However, regardless of who selects the custody evaluator, the same type of preparation and protocol as described still applies. An informed parent and attorney can ensure that the proper procedures are followed during a custody evaluation - no matter what the circumstances may be. If proper procedures are not followed, then there may be grounds to challenge the custody evaluation.
