Pro se filers can also purchase state-specific divorce kits. The kits often come in boxes or in book format with blank forms required in divorce. The kits include step-by-step instructions for filing a pro se divorce. The kits include properly completed models of each form. The completed forms are then filed in the local county court. These types of divorce kits are often very generic or boilerplate and are often not specific to a particular state or jurisdiction. Depending on the quality of the kit the uniqueness of ones situation, many facets of the divorce can be overlooked especially if the filing spouses have minor children. It is not uncommon for these type of divorce kits to not even address the children, and most require that you waive certain rights such as splitting retirement accounts or receiving alimony or spousal support. At one time divorce kits were readily available at office supply stores, but this is no longer the case. Due to the complexity of divorce form preparation and the filing procedure, most stores have removed them from their inventory because they were often returned unusable. The value in divorce kits lies in the fact that they get the process started. Often time spouse will fill out these documents and it will aid them in the process of reaching an agreement with one another. Essentially they are a tool in the negotiation phase of the divorce. Once in agreement, the spouse can furnish the documents for the kit to a lawyer for the actual divorce paperwork to be prepared.
Keep in mind that there are divorce kits available that are very state-specific and are of very good quality for the money. Certain ones also have the forms on CD-Rom or accessible though the internet for easier computerized completion. This being said, do your homework before making the purchase and wasting your time and money.
