How Long Can Alimony Be Awarded in Maryland?

In Maryland, alimony is typically awarded for a period of "rehabilitation" until the spouse receiving alimony can be expected to become self-supporting through education, training or work experience.

The Court can award indefinite alimony if it finds that: (1) due to age, illness, infirmity, or disability, the party seeking alimony cannot reasonably be expected to make substantial progress toward becoming self-supporting; or (2) even after the party seeking alimony will have made as much progress toward becoming self-supporting as can reasonably be expected, the respective standards of living of the parties will be unconscionably disparate.

Indefinite alimony may also be awarded in cases where parties have a lengthy marriage and one spouse will always earn substantially more than the other spouse.

Maryland law requires equitable distribution of property in a divorce. The court determines a fair award of property and debt. Unless the couple can reach a settlement, the court divides the marital property, pension, retirement, profit sharing or deferred-compensation plans. The court considers contributions of each party, the well being of the family, the property value, the economic circumstances of each spouse as well as current situations such as age, mental state, the duration of the marriage, and the interest each party has in the property.
