Grandparent Rights to Visitation:

Visitation may be granted in regard to a child as to whom a disposition has been made under Title 41 or when the court finds that the visitation would be in the child's best interest.

Title 40, Chapter 9, Section 40-9-101 (M.C.A. 40-9-101 et seq.).

When Adoption Occurs:

Visitation rights terminate on adoption by anyone other than a stepparent or a grandparent.

child's wishes;

interaction and interrelationship between child and parties, siblings, and other significant persons;

child's adjustment to home, school and community;

mental and physical condition of all persons involved;

any physical abuse, or threat of physical abuse, against a party or the child;

any chemical dependency or abuse of either party; and

any other relevant factor.
