Iowa: Iowa Divorce Forms and Explanations

This is a list of the most commonly filed divorce forms for the state of Iowa. Following the list is a brief summary of each form and its purpose. This list of forms is not exhaustive and not all forms listed are required for every divorce. Due to unique case situations and special divorce filing procedures in Iowa, certain forms may or may not be required by the Iowa courts.

Petition for Dissolution of Marriage with No Minor Children, form FL-101

The three-page Petition for Dissolution of Marriage with No Minor Children identifies the parties, birth dates, addresses and states that the marriage "is broken and cannot be saved" and requests relief.

Coversheet for a Petition for Dissolution of Marriage with No Minor Children, form FL-102

The Coversheet, filed by the Petitioner, is a one-page form that identifies the action as a "Domestic Relations -Dissolution - no children (CD-DN)." A copy of this sheet is not provided by the Respondent.

Confidential Information Form, FL-103

The Confidential Information Form, a one-page form, must be completed by each spouse. It provides the Social Security Numbers of each party.

Original Notice of Personal Service, form FL-104

The Original Notice of Personal Service, delivered to the Respondent with a copy of the Petition for Dissolution of Marriage, is a Summons that puts him or her on notice that he or she has 20 days to file and Answer or Motion in response, or face a default judgment.

Acceptance of Service of Original Notice, form FL-105

The Acceptance of Service of Original Notice, signed by the Respondent, attests to fact that he or she has received the Original Notice of Personal Service and the Petition and he or she accepts it. It does not mean the Respondent agrees with the allegations in the Petition.

Directions for Service of Original Notice, form FL-106

Directions for Service of Original Notice identifies the party receiving Service of Process -- the delivery of the Original Notice and Petition to the Respondent.

Motion and Affidavit to Serve by Publication, form FL-107

The Motion and Affidavit to Serve by Publication attests to the efforts made by the Petitioner to locate a spouse who cannot or will not be located to accept serve of the Original Notice and moves to permit Service by Publication. The Motion and Affidavit to Serve by Publication must be used when the Respondent cannot or will not be served in person.

Original Notice by Publication, form FL-108

The Original Notice by Publication, used when the Respondent cannot or will not be located, is published in a newspaper in the county where the action is filed. It is published once a week for three consecutive weeks. The Original Notice by Publication is used in conjunction with the Motion and Affidavit to Serve by Publication.

Application and Affidavit to Defer Payment of Costs, form FL-109

An indigent Petitioner may file an Application and Affidavit to Defer Payment of Costs, which exempts him or her from filing fees. This form is optional.

Motion, FL-122

A Motion form is sued when a party asks the court to take some action on the case, including a) changing any hearing date, b) awarding temporary support, c) ordering counseling (conciliation), d) setting a hearing date for a Divorce Decree by Default, e) abbreviating the 90-day waiting period or f) making any other request. This form is used when one spouse maneuvers in ways with which the other spouse disagrees.

Response to a Motion, FL-123

A Response to a Motion is used by the other party when he or she objects to a request in the other spouse's Motion, FL-122.

Financial Affidavit, FL-124

Both Petitioner and Respondent must complete a Financial Affidavit, an eight-page form which details the asset and liabilities, expenses and income of each party. Failure by the Respondent to complete a Financial Affidavit means the Petitioner can be awarded a Decree by default.

Affidavit of Mailing Notice, FL-125

A Petitioner who serves the Respondent by publication must file an Affidavit of Mailing Notice when he or she asks the court for a Decree by default.

Notice of Intent to File a Written Application for Default Decree, FL126

Notice of Intent to File a Written Application for Default Decree which the Petitioner must file if the Respondent has not answered and the Petitioner now seeks a final divorce Decree.

Request for Relief (Final Decree) in Dissolution of Marriage with No Minor Children, form FL-127

The Request for Relief (Final Decree) in Dissolution of Marriage with No Minor Children is used when the Petitioner is getting a default divorce, in which case it is completed by the Petitioner, or by the spouses who are heading to trial.

Settlement Agreement for Dissolution of Marriage with No Children, form FL-128

Settlement Agreement for Dissolution of Marriage with No Children is used when the parties have reached agreement about the terms and conditions of division and distribution of assets and liabilities.
