Grounds for Divorce: Alaska
Each state has unique grounds in which a divorce may be granted by the court. When choosing the grounds for your divorce, you should always remember that you must have sufficient proof to the court that your marital situation warrants a divorce by the grounds you are requesting the divorce to be granted.
Grounds for Filing: The Petition for Dissolution of Marriage must declare the appropriate Alaska grounds upon which the dissolution of marriage is being sought. The appropriate lawful ground will be that which the parties agree upon and can substantiate, or that which the filing spouse desires to prove to the court. The dissolution of marriage grounds are as follows:
A dissolution of marriage may be granted for any of the following grounds:
No-Fault:
incompatibility of temperament which has caused the irremediable breakdown of the marriage.
Fault:
(1) failure to consummate the marriage;
(2) adultery;
(3) conviction of a felony;
(4) wilful desertion for a period of one year;
(5) cruel and inhuman treatment;
(6) habitual gross drunkenness;
(7) incurable mental illness;
(8) drug addiction.
