Visitation may be granted if either the parents are not cohabiting on a permanent or indefinite basis, one of the parents has been absent from the martial residence for over one month without the other spouse knowing his /her whereabouts, one of the parents is deceased, one of the parents joins in the petition with the grandparents or great-grandparents, or if a sibling is in state custody.Illinois Compiled Statutes, Title 750, Illinois Compiled Statutes, Section 5/607 (750 I.C.S. §5/607).
When Adoption Occurs:
Visitation rights terminate unless the adoption is by a stepparent.Child Custody Statutes:
Best interest of child considering:750 I.C.S. §5/602 et seq.
- wishes of parents and child;
- interaction and interrelationship between the child and parents, siblings and other significant persons;
- adjustment to home, school and community;
- mental and physical health of parties and child;
- any physical threat to child;
- each party's willingness to encourage and facilitate continued contact between the other parent and the child.
