Grandparent Rights to Visitation: Visitation may be awarded if either the child's parents are divorced, a petition for dissolution of the marriage is pending, the parent who is the child of the petitioning grandparents is deceased, the child has been placed in a foster home, the petitioning grandparents are the parents of the noncustodial parent and the other parent's spouse has adopted the child, or the grandparent is the parent of the child's noncustodial parent and the child had been born out of wedlock. The visitation must also be found to be in the child's best interest. Iowa Code Annotated, Section 598.35 (I.C.A. §598.35).
When Adoption Occurs: Visitation rights terminate unless the adoption is by a stepparent.
Child Custody Statutes: Best interest of child "which will assure the child the opportunity for the maximum continuing physical and emotional contact with both parents." I.C.A. §598.21.
