Grandparent Issues: Kentucky

Grandparent Rights to Visitation:
Visitation may be granted if the court determines that the visitation is in the best interest of the child.
Chapter 405, Section 021 (KRS §405.021).

When Adoption Occurs:
Visitation rights terminate except in the case of a stepparent adoption where there has been no termination of the parental rights of the parent whose parents are seeking visitation.
Child Custody Statutes:
Best interest of child considering:
  1. wishes of parents and child;
  2. interaction and interrelationship between child and parents, siblings and other significant persons;
  3. child's adjustment to home, school and community; and
  4. mental and physical condition of all persons involved.
