An arbitrator is a neutral third party who will be presented with the cases of both sides and reach conclusions with regards to specific issues that will be incorporated into a particular court judgment. The primary difference between mediation and arbitration is the fact that, unlike mediation, there is no room for actual negotiation. An arbitrator's decision, for example, what a particular business is actually worth, will be final.
