Child Support/Adult Disabled Child/Application of Guidelines:

This case presented two child support issues. The first issue is whether child support is required from the noncustodial parent where the child is over eighteen years old and regularly attends high school but, because of suffering from Downs syndrome, is not making progress toward a traditional diploma. The second question is whether, if child support is mandated, the trial court can set the amount by merely halving the sum due under a prior order where one of the two children earlier included has now moved beyond required support. The court held as to the first issue that as long as the child is making progress in some manner support must continue. As to the second issue, the court held that support must be made consistent with the guidelines, and it remanded the case for that determination. Hendricks v. Sanks, No. COA00-91 (N.C. Ct. App. May 15, 2001).
