I filed for divorce less than a month ago and am doing everything on my own with the help of a book. My wife and I already have a settlement agreement and everything is filled out, just needs to be signed and filed with the court. She tried to file her "response" the other day - following the instructions in the same book. Instead of filing a FL-120, she filed a FL-130 (Appearance, Stipulation and Waivers), since it's all consensual, with her filing fee. The court clerk sent it back, however, stating that it was missing some other forms. I really don't have much time to drive to the courthouse and wait to speak with a family law facilitator, so I was wondering what the problem might be in filing a FL-130 instead of a FL-120. She would make an appearance this way so that we could file all the other documents before the 30-day response period. Everything else is ready, she just needs to pay her $320.
Any ideas? Why won't they accept the FL-130? What other forms does she need to send in with it? Or is there another way to do this? The book is pretty vague on the issue, just says that she could make an appearance this way without filing a response (FL-120). Thanks for any help.
