The state and government don't "get involved". We involve them. One or both of the parties has to take it TO the state. If the parties don't divorce, split, sue for custody or CS, or put their hand out for the state to feed them, etc., the state isn't going to say anything, they're not even going to know about the parties in that respect.

The "ownership" of a child is easy enough to determine from the woman's standpoint in that there is a record. It comes out of her body. There are witnesses (doctor's, nurses), hospital records, etc. Unless the man has witnesses standing by in the bedroom though, he's SOL in that department and has to "prove" his rights to that child without an agreement between the parties. Nature made it that way, the partys' inability to agree necessitates the court stepping in to make a determination that nature didn't provide the proof of up front.
