Stay out of Small Claims Court , you'd get a judgement that isn't the easiest to enforce and subject to discharge in bankruptcy. SC CS Enforcement cannot help as they won't enforce a claim for unpaid medical expense . The best way is to hire an attorney and request she pay your legal fees which also has risks ( she wouldn't pay anyway ) . You could always try yourself and hope .
