Who cares if they're in daily contact? You all are divorcing.
As for custody....why not ask for at least 50/50 custody based on the fact that you're at the very least, as capable of parenting as she is? I wouldn't base your request on your STBX's paramour. He was a stupid kid that made a horrible mistake who may or may not find himself in a better, safer, more mature place. They may or may not try to make a life together. Time will tell on that one.
