Parent Moves Away....Insight Please

Both parents have 50/50 custody. Mother moves 4hours away and never tells father. Maternal grandmother has been coming 4hours away every 5 days to take care of child because mother left. Mother says she left because she could not find work in the state where she lived. What mother did not say was she was fired from her job due to gross negligence(HIPPA Viloations). The child was never removed from home state but instead of her telling the other parent to modify custody, she had her mother coming and keeping the child.
Parents tried to mediate but mother wants to take child with her and father would not agree. Mother's argument is that she could not find work but during this time she has made several large vehicle purchases not only for herself but her boyfriend.
I know most say just get custody modified however how can you do this when one parent is not willing to cooperate and continues to get what they want so this is delayed and not a rushed issue. Mother left in July of 2011 and father was not aware until December. Child is almost 9 and was told not to tell. Court is coming up soon but just wanted any opinions on this issue.
