Went to court for a bench trial after discovery. We thought we could settle so we went outside and discussed a settlement. The judge encouraged it and the judge did not decide one thing. The settlement we agreed to in the hall was written on a piece a paper. It was read into the court transcript and we all agreed under oath. Her lawyer said she would write a settlement up, bugt added a bunch of crap or things that was just not discussed. We still can't settle or in other words neeither will sign a settlement agreement. There are still just way too many differences. Question. What happens now if we don't reach settlement. Does the judge start over or does the judge take the transcript that was agreed to by both parties. I have been paying the support, doing all the things that we agreed to regarding visitation etc., and living somewhere else. What happens next. By the way - I have now had second thoughts about what I agreed to as has the spouse and we can't agree. What does the judge do or what can I do or what does she do? Can we start all over with a new trial? Or are some things in stone? |
