401k early withdrawl

I'm hearing conflicting information regarding withdrawing from my 401k at the time of divorce. From my lawyer I've heard that there is no penalty (except 20% tax) to withdraw from it, as long as it's done within 30 days from the divorce being finalized. However I've also heard from somebody "close" to a financial adviser who said that all early withdraw penalties would apply, regardless of the divorce.
