Unfortunaely it states in the Texas family law that the judge has wide discretion in calculating child support, which leaves a lot of vagueness. This is why you must have to have a good attorney to make a good agrument for you regarding this issue. My attorney's were able to push the point about what the federal law says about military child support. In a lot of these divorce cases people will try suck as much money they can out of you. My ex did not contest this issue, because my lawyers were able to show her lawyer that this was written in stone that bah, bas, and clothing allowance are exempt. My attorney was ready to fight this issue at trial, but she finnally agreed and waived her testimony. I'm thankful to God that he was able to work through my military legal office that handles child support garnishments, to show me what cfr.581 says about military child support. This is why it pays do your own research and present this type of information tou your attorney's so that they can fight better for your rights. The more information you give your attorney the better.
