They could actually both get full BAH, if they are moth military, DH because he is married to OP, and NCP, if she were to become the CP with the proper documentation. he would get it for his spouse, BM would get it for having the child as living with her. There would be more money for both, but if I were the CP, there is no way I would sign anything saying something different.
