Her lawyer was a fool. Relocating with children out of state without the other parent's consent is a recipe for disaster. Both parents have equal rights to raise the children. When one parent makes a unilateral decision to leave, leaving the state, and the home that the chidlren have known, puts the other parent squarley in the driver's seat to seek custody. It was a blunder and a bad one. She may seek occupancy of the home as part of a temporary hearing but her leverage and arguments in that regard are significantly weak since she moved. She is in a bas spot. I would suggest she find a suitable home in the area to have a decent arguing point for temporary custody |
