This waiver of process scares me. ---> A 'waiver of process' simply means that you are willing to forgo formal process...having a process server/sheriff come to your home or business and hand you the paperwork...that it is OK to 'serve' you via email or USPS. Can I represent myself if I do end up having to go to his state? ---> Yes. ---> As for who has jurisdiction...it sounds like your state has jurisdiction. If such is the case, then your response to your ex would be to have his Motion dismissed for lack of jurisdiction. ---> You need to get that paperwork ASAP because if he has filed an Emergency Motion, odds are that he has already had an Ex Parte hearing and you need to find out what the results of it were. Because 1) he could have been granted emergency temporary custody or 2) he was turned down. And if he was turned down, you want to find out why. |
