MrsWilliams - don't worry about your ex-husband's tax filing. Claim your child as your dependent (on you joint tax return) and you should be fine. You may receive an IRS notice because they may recognize two people claiming a deduction for the same person (which they track by Social Security number). If you get a letter, you can respond with a copy of your divorce decree (which should state that you are the primary custodial parent) and a letter from you stating that you pay more than 50% of your childs' expenses and the child stays with you more than 50% of the time.
