Oh see, I read it differently that legal separations DO count. That you could then file married filing separately or even single (which is what the lawyer my 2nd husband had advised BOTH of us at the time we filed our divorce, again no separation, in December of a year, with the decree coming May the following year.. had forgotten that, actually I've done that twice, lol).

Anyway, just a curiosity if the IRS, in doing audits (now that I realize that one of those situations WOULD fall within the 7 year rule) cross checks vital records? The 2nd one, which falls within the 7 years, I'd be less concerned about b/c we were advised by counsel (and he validated with his own accountant) on how to file..but still....
