I don't have the exact wording in front of me; however, it says something like IF you were officially divorced as of 12/31 OR you were under a formal separation agreement. I'd have to go back and find the wording. But it does state you can file separately if you have a formal separation agreement. My issue is that I did NOT have a formal separation agreement. Or maybe a Stipulation of Settlement is? That I don't know.. but it's not like the Judge saw the Stip of Settlement by the time 12/31 hit in the 2nd case. We only filed for divorce on like 12/20 or something. And I know it didn't hit the Judge's calendar til sometime in March (we can track cases via the web here).

Anyway, I just find it interesting.. How do they know?
