At what age can kids decide?

At what age can the kids decide who to live with?
My sister has custody of her two kids; they are right now 10 and 12. She needs to someday move a few hours away to NC for personal reasons. Of course, a move to another state would force a change in visitation. She doesn't get along with her ex at all, so trying to work something out beforehand is pretty much out of the question.
Anyway, it's kind of a long story. But my question is, At what age do the kids get to decide which parent they want to live with? She won't leave the area if it means giving up custody, but she needs to get away from him and away from the area and restart her life. And the kids would definitely choose to live with her, given a choice.
