If you don't have a custody order now, you may have to do a "mediation", depending on your state. The parents - without their attorney's - meet with a mediator and try to decide a plan on their own. If you do this, make sure to have the mediator document every day, time, holiday, birthday, mothers day, halloween, vacations, EVERYTHING! To avoid later issues. My state even requires a class prior to meeting.

If it has to go to court cause no agreement was made, the court should frown upon his keeping your son away.
