Spousal support
|
|
I have a temporary PFA for my husband, I left the marital residence (because his parents live next door) and granted him temporary exclusive possession because of the same. I am the CP. A few weeks ago I filed for child and spousal support. I got papers today that he filed for spousal support as well. Is this pretty routine? I make about 20% more than he does.
He eliminated me from his insurance policy and therefore I have unresolved medical bills (several hundred $) that my attorney is trying to recover from him. The woman at domestic relations said that by filing for spousal support, even though I make more than he does, it would be a good way of getting this addressed. Was she correct?

I would think the unresolved medical debts you incurred would be something addressed as part of your asset separation, not as a means of spousal support -- especially since you make more than he does.
Child support as the custodial parent? Sure. But not spousal support, which is usually something that is addressed over a period of time, and not as a lump sum payout.

"I make about 20% more than he does. " And you asked for spousal support?!?
"it would be a good way of getting this addressed. Was she correct? " Uh... no.

Why would you file for spousal support when you make more than him?
He is more likely to get SS from you since he is the lower-wage earner.
No, filing for SS isn't a good way to get medical bills resolved.

Because the woman at Domestic Relations told me that it didn't matter if I made more, it wouldn't hurt to file, the worst that could happen is I would be denied. She practically told me to file.

Well, one of two things...
|
|
...you faily intelligent, knew what you were doing, and are using the woman at the Domestics Relations office as a scapegot for YOUR actions, or you are simple SO incredibly STUPID that you can't think for yourself.
Which is it?

I am intelligent, however, I do not have a broad base of legal knowledge. Just because you are intelligent and have an education doesn't mean you know EVERYTHING.

Yes, because it take a HUGE amount of legal knowledge to decide if YOU, who makes MORE than him, should be having HIM pay YOU alimony, right?
Or are you unaware of what alimony IS? Seems pretty simple, it is compensation for lost earning capacity during the marriage.
I have SEEN your type, I KNOW them. It's ALWAYS someone elses fault, "I didn't WANT to file that, my lawyer MADE me."
And if you think those of us who have BEEN through the system believe, for ONE second, that you told a OFFICIAL person that you made more, and they advised you to file for alimony, honey, you are on the wrong site. Either you LIED to her, or she told you no such thing. Either way, you are ACTING like a complete MORON by expecting ANYONE to think you didn't KNOW any better, LOL!

Pleadings, the Summons and Petition and the Answer, are positioning papers. You ask for the stars and expect the moon. If you earn more, chances of spousel support are slim to none. I don't know if the spouse's claims are less likely without knowing income. Nonetheless, it creates points on which the parties now bargain.

I have no problem with the ASKING, it is the courage of conviction to SAY they asked, instead of blaming it on the lawyer or some other official.

LOL --we are used to such blame as you will see on this site. It is all the lawyers fault.

I work for the government, you'll just have to send most of it back to me in taxes.

I will enjoy my $2 out of that $75. Please make sure to spend the rest on a toilet seat for the governor.
