Does Rehab help or hurt a case?
|
|
As you know, my ex wants custody of my oldest (13) son. He has recently completed another rehab stint and feels this will gain him termendous respect in the eyes of the judge. This will have been his 3rd run in 3 years. My question is will he have more credability to the judge. I do know he is back to drinking but I have no reason to believe his is back to drugs>. Will this help or hurt his case?

I'd think hurt.. shows instability... 3 times in 3 years. If it had been one time successful 3 years ago.. that'd be different. It still isn't ever a completly positive thing.

I don't think it'll increase his credibility to the tune of changing custody - not unless he can prove you are a horrible parent.

Rehab itslelf does not hurt a case.. it shows that a person had a problem, sought help and has recovered. The act of being in rehab three times in 3 years.. means- they are NOT recovered... So in your situation.... it won't HELP him at all.

I spoke to him tonight and he says that he he will do rehab again if I or the jusge grants him custody...I claims that if he has custody it will give him a reason...

Agui , CA has strict laws regarding child custody and substance abuse ( I've posted them for you before & that includes alcohol ) , so count on rehab being a negative in the court's eyes .

Yeah it really sounds like he is not the one to have custody, in this case I cannot believe a judge would look on this favorably, and of course if thats the only reason he would go into rehab again, I would have to question his desire. I think the truth should be told and in this case the truth will not help him, but will help the child.
