He's spending money and we're not filed yet ..

In Illinois ....
The attorney will be filing Monday. Over the last three weeks he's run up a $3K+ bill on new electronics for his apartment. Attorney says the bills are HIS to pay BUT, won't this make it look like he already has a bunch of debt and will not have to take as much of the martial debt that we already had?

No, it will look like he deliberately ran up debt to stick it to you.

Have you discussed with your lawyer about closing any joint accounts so that no one can charge them up? The existing balance remains, but no new charges can be made. Your STBX would need to use CC's solely in his name for future purchases. If you are just an authorized user you should be calling up the CC companies and asking for your name to be removed.

Thank you for responding. I've already closed all our joint credit card accounts. This is a card he opened in only his name a few weeks ago. Our joint maritial debt is on a credit card that is only in my name. I moved the balance to it in January of this year because it had a much lower interest rate. He's agreed to take part of that debt but I'm concerned he won't have to now that he has his "own" debt.

Have you talked with him about transferring some of the balance onto his new CC using a balance transfer?

He verbally agreed to take a third of the debt. I make just just slightly less then twice what he does. I don't want to put him in a position that he can't get by because he'll have every other weekend visitation and the kids will be staying with him. I just don't want his mid-life crisis spending to force me to take all our maritial debt.
