need some info

I need to know if I file for divorce in Ohio and my spouse doesn't want to sign the paperwork does anyone know if there is a default law in Ohio? If she refuses to sign it or get an attorney will they file the paperwork to the courts anyway??? after a certain amount of time will I win by default?

All states have a default rule. You servethe divorce and the other party has a certain time to respond. (Usually 30 days). If they do not you file for default and a default hearing is held.

so then if the hearing is set and she doesn't show up for that then it pretty much goes thru in time correct? I just come from a culture that doesn't believe in divorce really and they think by ripping up the papers that, that will stop the process but I know better then that just wondering. thx

Sorta. The Judge often asks questions. The settlement must still be sorta fair. Generally, you get what you want so long as it is within the realm of reason. At least that is how it works around here.

well I said joint custody paying her 800.00 a month for 2 kids. Nothing more then that. I just want out. Its an arranged marriage and now I know its not what I want for me or my kids. Just want out of the marriage. thx so much for the help. It makes me feel alittle better. Its not going to go smoothly but I know she thinks that if she tears up the papers that makes it stop.
