Threat to take kids out of state
|
|
I have a coworker who is pursuing a divorce. Her spouse has threatened that if he even thinks she is seeking a divorce that he would take the children and run off to Florida. She has spoke with the sheriff's department and CSB and she said their is nothing she could do about it. Is this a fact? What can she do to make this not happen? She is a good mother and I hate to see kids go through this.

File for emergency temporary custody until the divorce is heard. If he then runs off with the kids, he breaks the law as she will have had custody of them. She can also call a local women's shelter and seek advice from them since she is being threatened and held in a bad marriage by threats and intimidation.

I agree with almostheaven. The minute she files for divorce, it should be accompanied with a request for a temporary custody hearing. It would be great if she had any proof of his threats.
The sheriff is right...for the moment. Without a court order, he's free to take the kids wherever he wishes.
