Can CA Paralegal GIVE ADVISE?

My Mom is so mad at me now because she says I am not 'taking her advise' and 'listening to the paralegal' we saw yesterday and she insists that I should do what he told me to and 'go for $1650 alimony'. Mom knows nothing about law, her last divorce was 30 years ago and I found some guy in the phone book, a paralegal and he told me to go for full amount of alimony instead of sticking to the deal husband and I made for me to buy him out and gain most our house instead of asking for alimony... I took her into his office because I thought having her in there would help, you know an extra set of ears. But she for some reason (against all other's advise) thinks that I should sell the house (even though he and I just refinanced it so I could keep it) and live in a crappy apartment, and gamble on a chance that after losing the house I might "MIGHT" get some alimony. Then I'd have no house and probably no support. I have no kids, married 8 years, he makes $60K but is basically giving me the house (which has $110K equity in it) for $20K... Now my Mother is fumed with me over what this "paralegal" said in his office yesterday and now I'm learning here in another forum that he wasn't even supposed to give me advise. Not only do I have my husband bugging me for this money to buy him out of our house, now my Own Mom is ready to disown me for not trying to screw him over. I feel this paralegal just wants me to get into a nasty fight in court where I'll have to pay $$$$ and we'll both get screwed. :( Help :(

Re: Can CA Paralegal GIVE ADVISE?

you need to seek the counsel of a lawyer.

it is nice to have family support but only when the family truely indeeds gives the kind of support you need.
stipulating how you will divorce or disowning you if you do not do what "they" deem is right is not support.

there is the house that ties you to your husband, no children and in your own words a 2 year separation - you will have difficulty seeking ownership of the house without paying him his share and alimony. not to mention but you also met=ntion about refinancing it recently...how easy will it be to sell from this point and realistically - can you keep it on your own?

try calling around to different lawyers to see if you can get a free consultation, maybe that will help.

Re: Can CA Paralegal GIVE ADVISE?

Getting legal advice from a paralegal is like having brain surgery in a back alley from a medical assistant.

It is called practicing law without a license.
