Divorced last year, a couple of basic questions
|
|
Divorce final prior to end of 2007.
Who claims the state refund as income for last year?
XH signed a quick claim deed on the primary residence. Is he entitled to claim a portion of the interest or property taxes paid last year?

If the mortgage was paid from joint funds all year, I think you should split it evenly. If only one worked, then I think that one should get all of it. Otherwise, it should be split proportionately based on who paid it.
As for the state refund, since you probably shared it, then I think you should split it evenly.

That makes sense. How do we file though, when the documentation doesn't break it out in that manner? There's only one copy of the tax refund from the state, etc.

Typically that will be on a 1099 with "his" SSN. So he would put all of it on his return and on the next line, he would put "Nomineed to ###-##-####(her ssn)" and then she would put just that portion nomineed to her on her return as income. Same thing with any shared interest income and morgtage interest expense.
