ok heres my situation. im 21 and legally married for 2 years. ive been with my husband for 6. we have a 3 year old son. he works out of state, and has been gone since august of 2010, coming home for a couple days for the holidays. i was having an affair for the last 6 months. the "other guy" sent explicit pictures and videos , and well,my husband found out. he wants a divorce, which i am not willing to sign. the problem is, the wants to take full custody of our son. he has choked me and physically thrown me around, but i never filed charges. will he be able to take full custody with only the evidence of the pictures? or do i stand a chance in court because he is always gone and is abusive, and not to mention has gone back on drugs. so please all the help is greatly appreciated!

The affair should have no effect on custody. Next time he abuses you, call 911. If the case goes into litigation, ask for a psych evaluation and drug testing, and have a GAL appointed.

She said he was back on drugs. I assume she means hard drugs and has evidence to back it up. If not, the judge will deny the request.
