Can she receive SS?

Hello all, first post here. My wife & I reside in the state of MS and have been married for just over 10yrs (separated off/on for the past 2yrs of that marriage, currently separated). 3 children in the marriage, all are from my wife's previous marriages. ie. none are mine by blood and I haven't adopted them. Youngest child is 18yrs old.

I make around 55k per year and wife makes around 22k per year.

Do you think she would be granted spousal support if she pursues it and if so, for how long? 5yrs?

Also, since the children are not adopted by me and are not mine by blood, is there a chance she would be awarded child support?

If the youngest child is already 18, I'd have to say there is no chance you'll be paying any CS.

Alimony is another matter. This is a large disparity of income between you, and since the marriage is greater than 10 years, it's considered a long-term marriage.

The kids have no bearing in any of it, even if they were 6. They are not his and he didn't adopt and it is not considered in awarding SS. What is depends on is her education and ability to make a living

And I would add that 22K vs. 55K isn't that huge of a disparity. Now my ex and I, that was another matter... I made 6 times what he did. If we went to court my lawyer said it was possible I'd pay 15% of my gross for LIFE. (19 year marriage in IL). Thank goodness he settled so we didn't have to go to court. No SS!

There should be no SS in this day and age, unless a woman wants to sit on her ass, which you obviously did not do

First, there is sposal support if you are involved in a long term marriage and the other spouse cannot support herself. I disagree, there should never be any. With the numbers you indicate, however, any support would likely be short term.

Maury, you're a lawyer. That would be like the grocer saying there should be no frozen food section LOL

Again, in this day and age, the opportunities for women are on par with men. Very few men INSIST the wife stay home to watch the kids. And of the women I know, none would be so submissive to do it if they wanted to work. Of course, thats what they tell the court..he made me stay home...Ex#1 did that and a part of the reason I divorced her was BECAUSE SHE WOULDN'T GET A JOB....

If judges weren't so concerned with getting re-elected or re-appointed, they would also call out every woman who used this excuse in this day and age.

Its wrong to use this manipulation in court, and its wrong that its not stopped when it gets in front of the judge.

Women are their own worst enemy when they complain they're treated unfairly, yet they pull the Little Woman card in court.

Exactly my sentiment. As I said, my first ex did this and a primary reason I divorced her was she wouldn't work. And STILL didn't work after the divorce. "Oh poor me". It's all BS. I paid, and it was stipulated the money was to be used to "further her education". She never went to school. I tried to have it stopped for that reason. Ya, right. I though she could go AT LEAST to a community college....no deal...she also would have qualified for a Pell grant..no deal...

Yet, in the work enviroment, they cry foul. She never made a work ATTEMPT until 2 years ago when CS ended. Her husband still dosen't work.

Women not being "equal" is their own doing. My Mom turned down alimony, instead got a grant and went back to finish her degree and became a teacher. And I've never seen a woman paid less for doing the same job as a man, and I've set and seen plenty of pay scales throughout the years, so thats a myth too.

Ahh, now there I beg to differ. Women getting paid less for doing the same job, with the same education, and the same performance evals is not a myth. You may not have seen it, but it happens. I have been privy to the salaries and ratings of co-workers of mine and know for a fact that there are two men who are getting more than me, and actually 3 men getting less. The only reason I can find for the difference other than a double standard in pay scales is their hire date. I can guarantee you though, its not a myth. Its just as real as the other gender-based double standards out there.
