Hi Everyone My ex took me back to court to increase spousal support and Im waiting for the verdict but I think she probably will get an increase based on a sharp lawyer. She refuses to work and she lost some of the assets awarded in divorce court 4 years ago so she wants more money to make up for it. We had a 14 year marriage and we are both over 60. I have social security, a house and a IRA pension plan with stocks. If I disappear overseas is it possible for them to enforce an order for spousal support? What would likely happen if I sold my house and cashed out my other assets and went to lets say Taiwan or Singapore and lived there? Will I be arrested for ignoring a court order or what happens? You would have to research yourself to see what nations do not recognize US family law. I imagine it would be mostly 3rd world nations, but I don't really know.
To add though, they are going to tap your social security, since you can't "cash" that out.

The best solution is for your ex to get married. Worked for me. Pay some dude $10,000 to go thru with it. Trust me, she will never get a job, so don't expect that. Women don't consider work a good lifestyle option.

Doesn't she get half your social security under the 10 year marriage rule? Aside from that, it doesn't think it's possible to sever all ties with the US. You could be put on several watch lists nd the no fly list. And what about your estate?

If married for over 10 years, she would get an amount that is = to 1/2 his amount, unless her work history makes for a higher amount. This does not reduce his SS payment. HOWEVER, his SS will be intercepted to pay whatever he is court ordered to pay. You can't be put on any "no fly" list (I assume you mean pull his passport) until you are behind on payments.

Many thanks guys. Will they actually arrest or not let you fly if you are behind in spousal support? I thought that was just for child support (we have none.)
Do you know any accountants that specialize in helping you legally arrange your affairs to challenge spousal support. Not the hired guns that go into court, but the ones who know family law and will tell you what is legal and what will pass muster with the court. :D :D

Why would she get a higher SS payout if she screwed up things herself, and won't work?

They dont care that she lost the money in a risky investment. Its all based on how much income do I have versus how much income does she have. Her social security is less than half of mine and I have 1.3 million in total assets (home, pension plan, partnership) and she has $700K.

Ok, when you got divorced you obviously split your assets. So why does she think that now that you're split, and she has pissed away some of hers, she should be able to revisit support to increase it based on her stupidity?

In California there is a rule that if either party has a "change of circumstances" meaning financial cirumstances you can go back into court for a modification.
