I would like any information from those who've filed and what happened. Did you regret it? Was it a relief? What has happened since? That kind of thing.

I used to work as a mortgage loan officer and was shocked to learn that bankrupcy doesn't really hurt your credit! I couldn't believe it. Initially it drops your score around 50 points or so, but then you factor in no more late payments, a lower debt 2 income ratio, etc... its insane.
Within 6 months you'll be getting credit card offers, you can still do car loans AND mortgages (if you have a big enough down payment), etc...
Just don't make the same mistakes twice...

Consult with your attorney first and make sure they are aware of what is going on. I looked into that when my divorce first started, but found out my attorney did not know how to handle that in addition to the divorce and custody actions. I started to consult with other attorney's as well and found that the majority did not recommend that you file for bankruptcy unless it is absolutely positively necessary. One of the things that did help ease some of the creditors is sending them a copy of the divorce filings because all the debt was joint debt and was not the responsibility of only one to pay, unless that was the order as part of the court actions. I spoke with another individual that had to file, but he did it at the end when the divorce was final and the equitable was final. For me, I resolved all the debts that I had so I didnt have to file. Yes it was a lot of work, a lot of writing letters to work out deals and such, but in the end I worked all of it out and did not have to file. Then clean up your credit on the back end, sending more letters and proof of debt resolution to the agencies.

I do noy know what to do either. Iam facing divorse and banruptcy. Most of the debt is only in my name because my husband gave me an "allowance to take care of 5 people and well after 16 years I simply ran out of credit. I homeschool 3 kids and take care of an elderly mom, so Iam not a deadbeat or anything. 1 of our children has learning disabilities. When should I file. As of today I'am up to date on all my credit cards, not even a late payment. Thanks for any advice, abbey

Check with your lawyer Abbey, but usually if debt was created during the marriage, both partners are responsible for it, even if only one name was on the card.
Regarding moderation....that poster has been banned before, but he just keeps on signing up under new screennames. You can out him ignore by clicking on his name.....a new screen comes up where you can click on "ignore this poster." If you see a crazy post from someone with Father, Padre, or Dad as part of their name, it's probably him. Put them all on ignore.
