Wow we are up the creek. There is no way I can support my daughter for months with no support. How in the world do I tell her her horse has to be gone by next week when the board is due? This will completely destroy her. Thanks for the info I had no idea.

Maybe I could sell some of his tools or something. I have to do something immediately. I don't get paid for 2 weeks and he took this paycheck.

Child support will be retroactive to when you file, but you won't have an order in place for several months.
As another poster insinuated, you are going to have to put your money where priorities lie.....food, house payments/rent and utilities....that could mean losing the horse. Regretfully, divorce can make your plan go out the window.
Depending on what kind of bonuses he gets and for how long he has received them (and how long he has worked consistant OT), it sounds like his base pay is only around $35,000. That's just not alot of money to work with. Support won't be all that big.

In my state (OH), the temporary orders were signed the day I filed. He had 30 days to respond, but the temporary orders are binding.

I am in NC. The lessons are only $15 per week and the horse board is $275 per month. His bonuses and overtime are consisitant. He grosses a little over $50,000 per year over the past 6 years.

Most temporary orders also prevent you from selling anything that is community property. If you do, make sure you take a picture of each and every item. You will owe 1/2 the value to your ex later, so you will need a record of what you sell anything for.

I'd stay away from any explanation that includes "because your dad cleaned out the bank accounts". Have you talked to dad and asked him how he expects you all to live and pay necessities when he's cleaned out the accounts?
