I also posted this message at another board...sorry for so many postings.
After my parents found out that I was pregnant at 17, I was forced to get married. My ex husband at that time was 25. We were divorced less than 3 months after we were married. My question is this, can that be considered a rape? I was only 17. And if so, does he still have rights over the child that was conceived from that?

Hi...is the father involved with your child at all...Even thou he did get u pregnant when u were underage, i believe he still has rights to his child. My friend was 17 and also got pregnant by a 25/26 year old...he went to jail and everything and now has to address himself as a sex offender...however he is still able to see his son and has every right as the mother. Of course they are still on speaking terms.

At this late stage, most likely not. At that age, and considering your parents and you have shown consent via the marriage, a court wouldn't prosecute. If you were married when you had the baby, he automatically has rights. If you were not, he MAY need to petition the court to establish paternity in order to seek rights. If he doesn't do that, he has no rights. However, because you WERE married, even if divorced when the child came along, they may still use the married rules and automatically grant him rights. With rights, that means either parent is free to take the child. However, if you've had the child in your possession for a time, and he's not around, that's considered abandonment and the rules begin to change. You have the right to seek child support as well, but if you do, the court will surely grant him visitation rights (generally every other weekend and one night a week).
