Greetings...My stbx is living in our house, I moved to aptartment. He wants the house and I have no problem with that. He will buy me out at my fair share. The problem is that he has tried to refinance and becasue of his poor credit, he can't do so at this time. He wants 3 years use and occupancy. I have no problem with that except how do I get my name off the mortgage, but still keep my name on the deed until the 3 years are up? I do not wnat him to ruin my credit if he is late paying.....Thanks!!!! Angie

it is of my knowledge that you cannot remove your name from the mortgage unless a refinance takes place. you can remove your name from the deed with a quit claim though. if you prefer, post anything at the top of the message boards like under the subject boards which are frequented more often than the state specific boards. good luck to you.

If he cannot refinance and it is a joint loan then more than likely he will have trouble making payments or at the least he will be late on payments and that could and mostly likely will adversely affect your credit. I suggest you seek the advise of your attorney but, if you are on the deed then you can force the sale of the property to get your share. Without a new note you will not be able be able to remove yourself from this debt, which, additionally, will make getting additional or new credit more difficult for you.

Hi... Thank you for posting. He can make the payments, as I had never worked. He always made them. He wants 3 years use and occupancy, which I have agreed upon. In a perfect world, it would be nice to get my part of the equity now, but I do not want to force him into a situation that would make his payment too high. It is already a struggle. What I am going to do, is give the 3 years. My name is NOT on the current mortgage, nor will it be when he refinances, but it IS on the deed. Could my credit still be damaged? I know that when he pays me at the end of the 3 years of use, I will have my name removed, just not sure if it is wise to remove now,(maybe with a notarized letter stating what he will pay me and by when?) or If I should leave it on. Thanks for any and all help!!

What are options for ex in house - - no children and my name on deed and mortgage ONLY!! Decree ordered sale of house - - which she's trying to block ...making home undesirable, not mowing lawn, etc... not that she was clean before. Can I get her evicted ????
