new here and looking for info
      #1525 - 08/17/04 04:56 PM

Just found this website....my step daughter will be graduating this year and will turn 18 in March...she already has her 'college career' mapped out....psychology major with a spanish minor (carrying a 4.4 for the year...yes we are very proud) I'm not sure about the child support laws in VA and bio-mom seems to want to contribute as little as possible. I'm trying to find out if her obligation ends in the middle of the school year when her dear daughter turns 18...does it continue until she graduates in June? And is there any legal way to get her to contribute to the financial end of what the college costs are going to run???? Would appriciate any and ALL information ANYONE has on this subject.
Thanks [color:blue] [/color]

From what I have found in my readings is that cs continues through the 18th bday or through HS graduation - whichever is longer. Don't take it for gospel, though. I'm pretty new at this.

It depends on the state...and really whatever is put in your decree. My mother's papers stated that she was to receive child support while my little sister was living under her roof and until my sister either turned 19 or was gainfully employed. My sister actually dropped out of school and got her G.E.D. when she was 16 and didn't work at all until just before her 20th birthday, but she still lived with my mother. My dad took my mom to court to try to put a stop to the child support and was told that he had to keep paying it until either my sister was out on her own or working 40 hours a week and had her own health insurance. I think in this situation, it was absolutely ridiculous for a judge to rule this way. My dad was paying my mother more in child support per week than I was making as a 23 year old college graduate living on my own. Since my mother handed the checks directly over to my sister, she had absolutely no reason to go out and get a job b/c she was pretty much being paid to sit on her butt and do nothing.

---> It will continue until she finishes high school at least. Depending on your state's statutes and if the CS was modified AFTER the statutes went into effect since many states changed the laws...she could be liable for CS until the "child" turns 21 so long as the "child" is registered full-time AND maintains at least a "C" average.

And is there any legal way to get her to contribute to the financial end of what the college costs are going to run????

---> Not unless it was written into the original decree. Personally I don't think that "divorced/separated" parents should be ORDERED to pay support AFTER their "child" graduates from high school or pay for college as parents in "intact" families are not required to do so.
