I understand that my student loans, which came before our marriage are my responsibility, but what about the capitalized interest on the loan? Reason I ask is that I deferred my loans so that we could pay other debts that we acquired together and could not pay them off at the same time. Now I wish I never deferred my student loans. Could my Ex be responsible for any of the capitalized interest from the time we were married?

We are divorced but have yet to divide up the assets, debts, support and custody.

I think it would be your student loans - your problems.
However, you may be able to trade off some of the debts against your student loans.
Sounds like you need a lawyer or at least need to pay for a consultation.

I had a lawyer and spent $7700 but didnt really get anywhere so i filed a substitution of atty. I have not gotten a new one yet but may need to if we cant come to some agreement and end up in court. I am hoping to find something somewhere on capitalized interest in regards to student loans as I know the loans are mine but I could have been paying them off if it wasnt for the fact that everything we had we put into her business.

Almost nothing but shuffle papers around, copy my file, file some initial paperwork send a few letters to my Exs atty. and leave me with a bad tasted in my mouth.

Dude, I would get an accounting from your lawyer, ASAP. For $7700, you should have gotten a year of paperwork plus two or three court appearances!

I've never heard to it...you cannot cry sour grapes now because you deferred one bill to pay off another. So if you want your ex to pay the interest can she get the tax deduction too???

Bottom line...your loans, your problem. Lesson: don't ever defer anything to help another person, even your spouse. You WILL get screwed if you divorce.
