MOST GAL's recommend Psych evaluation... that is not saying he is a whack job.... I was ordered one and the ex was ordered one in our divorce by the GAL.... standard M.O.

If your EX was the CP, and blamed this WHOLE thing on YOU, then approaced you and said, "Well, this is all your fault, i have a TRO against you so you can't have any contact...oh yeah, can I have some money for the lawyer?"

All the TRO spells out is he cannot discuss/implede/interfere with the investigation. It doesn't take his visitation rights away because that's not what we were looking at doing. He even went as far as telling DCFS that he'll do what he wants and if his wife's kids are there then who gives a [censored]. Obviously making matters worse for his son. He threatened to go against DCFS agreement and take our son out of my mom's home, throwing father rights out there, when he has wifes 2 kids as permanant residents in his home. He couldn't understand the fact of importance that his son could not stay in a home with other children. that was the reason of the TRO. So he couldn't do ANY of that. So with that said, if he interrigated our son about the case (prior to being interviewed by officials) he is impeded/interferred if any of that makes sense. given his history with the judge, the judge didn't hesitate to sign off on it.

The TRO was done Dec 22, hearing on Jan 3. Removal of the son was done Dec 6

For his SON'S expenses, not my attorneys expenses. Obviously my/our son is 12 and we are both financially responsible for him. Do you think a 12 year old can pay for an attorney to defend him. I don't think so.

According to the poster.. with his compresion problems.. he may NOT know he is in trouble......
You can't claim that he didn't know what he was doing due to comprehsion problems.. but then claim he knows he is trouble and won't do it again.....
The case I had was very similar.... the child was 16, perp'd on his younger brother... younger brother perp's on a child in FC. Parents claim that 16 didn't know what he was doing and his IQ was around 50.... (he was a victim of SA by his father, but re-canted his story). anyway.. parents claimed on one hand that he didn't know what he was doing and he doesn't know the truth that is why he re-canted his story.. but on the otherhand... they know it will never happen again......
You can't pick and choose.... Child should not be returned to home until all evaluations are done. Child was under the mother's care and this happened... granted we don't ever think things like this will, but it's been shown that mother can not protect other children in the house... until evaluations are done and until treatment is recommended.... child needs to be isolated from other chiildren in order to protect them.

yes and that's what i have done already. dcfs and i already agreed on that the day of.
